TERMS OF USE AT PLANEARTH APS

These Terms of Use come into effect on July 1, 2024.

1. TERMS OF USE OF THE PLATFORM

The following terms apply to all use of the Plan Earth platform ("the Platform") and all other websites, applications, programs, services, and tools offered in connection with the Platform by or on behalf of Plan Earth and which refer to these terms ("Terms of Use").

The Terms of Use apply regardless of how you access the Platform, including, for example, via computer, tablet, mobile device, or other terminal equipment.

Although we do our best to provide up-to-date and accurate information, price changes, unintentional errors, and similar may occur on Planearth.com. Therefore, we point out that all content on Planearth.com is offered "as is," without guarantees of completeness or accuracy and without warranties of any kind.

Any user who wishes to use the Platform must accept these Terms of Use. If the user does not wish to accept the Terms of Use, the Platform must not be used.

3. INTELLECTUAL PROPERTY RIGHTS

All rights to content on the Platform belong to PlanEarth ApS and are protected under applicable law. Trademarks, service marks, trade names, logos, products, and other items appearing on the Platform may not be used, copied, sold, distributed, or reproduced without prior written permission from PlanEarth ApS.

4. THE PLATFORM

The Plan Earth platform is a tool-based platform that users can use to work with sustainability.

Its features include the ability to create an ESG report by entering company-specific data. The Platform also includes a strategy module, where users can create a strategy report by completing various modules and entering goals and action plans.

The Platform is intended solely for businesses and organizations.

5. USE OF THE PLATFORM

Businesses may use the Platform to:

  • Collect and submit data about their sustainability work

  • Continuously update and resubmit their data

When registering, a business must provide the name of a contact person, company name, and email address.

When a business user accesses the Platform and its content, the user must not unlawfully:

  • Unreasonably burden the Platform's infrastructure or interfere with its operation

  • Use any form of robot or other automated means to access the Platform or the data available on it

  • Request contact information from other business users, including email addresses or personal data, without the user’s knowledge and in violation of applicable data protection laws

  • Market their business on the Platform

  • Harass other users or upload material deemed offensive, infringing, or illegal under the Criminal Code (e.g., defamatory content)

  • Create, register, or act on behalf of a company that the person does not directly work for, own, co-own, or represent (e.g., as an advisor)

  • Spread or help spread viruses, spyware, harmful code, or unsolicited emails (spam, phishing, chain letters, etc.)

  • Interfere with or harm computers or systems on the internet, or try to gain unauthorized access to internet-connected computers or systems, or disrupt or damage the Platform (hacking)

  • Infringe third-party rights (including copyrights) by uploading, downloading, distributing, or similar actions

  • Use the Platform in a way that could damage Plan Earth's name, reputation, or goodwill

  • Perform other actions in violation of applicable laws

If this section (5) is violated, the user may be immediately and indefinitely excluded from using the Platform without notice.

6. SHARING OF COMPANY DATA

User data on the Platform will generally not be shared with other companies.

In some cases, with the user's consent, data may be shared under a separate agreement—for example, if the user is part of a corporate supplier program where data is shared from the supplier to the parent company. This will only happen as part of a specific written agreement outlining which data will be shared.

There is no data sharing with other business users on the Platform, except for anonymized business data used for benchmarking.

7. ACCURACY OF INFORMATION SUBMITTED TO THE PLATFORM

By submitting information to the Platform, the company confirms that all information is submitted in good faith, is accurate, and to the best of their knowledge, truly reflects the company’s sustainability efforts. PlanEarth ApS reserves the right to exclude a company from the Platform immediately and without notice or time limitation if it turns out that the company has knowingly submitted false information, manipulated data, or otherwise attempted to present an inaccurate picture of their sustainability efforts. PlanEarth ApS assumes no responsibility for such actions and reserves the right to delete such data immediately and pursue any claims in relation to violations of applicable laws.

8. REVOCATION OF CONSENT AND ACCOUNT TERMINATION

A company may cancel its consents on the Platform at any time. If a company no longer wishes to share data with PlanEarth ApS, it must terminate its account.

Once an account is terminated, all consents cease to be valid, and company data will no longer be accessible to PlanEarth ApS.

However, anonymized company data will remain on the Platform and be used for statistical purposes. PlanEarth ApS thus makes no guarantees for complete deletion of company data.

Users associated only with the deleted company will be automatically removed from the Platform. Users also linked to other companies will remain registered.

9. DOWNLOAD OF COMPANY DATA

PlanEarth ApS has no obligation to store submitted company data. Companies are responsible for making their own backups to retain the necessary data from the Platform for internal use.

Companies can freely export (download) their own data as long as the account has not been terminated.

Companies cannot request data from other companies that have not given permission for data sharing.

PlanEarth ApS has no obligation to return company data and does not retain copies or backups.

10. CONSENT TO USE OF COMPANY LOGO

If a user uploads the company's logo, the company consents to PlanEarth ApS using the logo in marketing materials. The logo may only be uploaded if the user is authorized to do so (e.g., as the company owner, with a formal authorization, or with specific permission).

11. CONSENT TO USE DATA FOR PLATFORM DEVELOPMENT

Plan Earth may use Platform data to maintain, offer, price, and develop the Platform.

12. DISCLAIMER AND INDEMNITY

Plan Earth disclaims any liability related to these terms, services, or use of the service, whether arising in or outside of contract, including consequential or indirect losses and losses due to simple negligence.

The above liability limitation also applies to damage or viruses that may affect your computer or property due to access to or use of the Platform.

Plan Earth is not liable for outages or interruptions, power or internet failures, system attacks (e.g., viruses or hacking), or any other circumstances beyond its control.

PlanEarth ApS also disclaims any responsibility for storing and/or backing up company data and cannot be held liable for data loss, unavailability, non-deletion, or non-retention. PlanEarth ApS is also not liable for third-party use or further distribution of company data, even if such data was exported from the Platform.

As noted in section 5, companies are responsible for selecting appropriate contact persons and ensuring the lawful disclosure of contact details to PlanEarth ApS. PlanEarth ApS assumes no responsibility and may delete such data and pursue legal claims if data protection laws are violated.

13. CHANGES TO TERMS AND WEBSITE

PlanEarth ApS reserves the right to change, modify, replace, or delete parts of the Platform content and may limit or stop access to the Platform at any time without notice and at its sole discretion.

14. PERSONAL DATA

Processing of personal data (first name, last name, and email address of a contact person) is done in accordance with PlanEarth ApS’s privacy policy, which can be accessed here.

15. COOKIES

When you use this Platform, we use cookies if you have consented to their use. You can read more in our cookie policy, accessible here.

16. PAYMENT TERMS FOR SUBSCRIBERS

The following payment terms apply to Plan Earth subscriptions:

The company pays a one-time fee and gets access to the Platform for 12 months, unless otherwise agreed in writing.

17. GOVERNING LAW AND JURISDICTION

These Terms of Use and use of the Platform are governed by Danish law.

The Copenhagen City Court shall be the agreed venue for all disputes, regardless of whether the case involves contractual or non-contractual obligations.

18. REVISION OF TERMS OF USE

PlanEarth ApS may revise and update these Terms of Use at any time. Any user accessing or visiting the Platform agrees to the Terms of Use, and users are encouraged to regularly review the current version.
